Giving customer cash back with no purchase

Hi, I live in Virginia-

 

if a friend walked into my store and asked me to run his card for $100 and give him $100 back in cash, could I legally do that?

 

would it make a difference if he made a purchase or not?

 

would I be allowed to do the same if I keyed in the card instead?

Giving Cash Back with or without a purchase is against the Terms of Service.  https://squareup.com/legal/payment see section 22 I believe on cash advances.  It would also get really tricky when you start doing it for friends and family to as that could be seen as a type of money laundering possibly too.  Plus you as the business will be eating approx $3 for every $100 you gave as cash back.
